As far as I know, it is at the discretion of the court which sentenced you to allow you to do the rehab course. For some reason, the judge might have thought that the course will not be of any benefit to you, hence he didn't recommend it.
However you can contact a
professional drink drive lawyer to see if there's any way that you can be enrolled on that course.
